Summary

The insolvency law represents a shift in the legislative philosophy adopted by the Jordanian legislator and is based on a set of innovative ideas that aim to maintain troubled economic projects by adopting new policies and procedures that help them rise to recover their health again if they are capable of doing so. One of the most important challenges facing the recovery process is the role played by the insolvency agent, as we have concluded that the tasks assigned to him are not without obstacles and difficulties that may hinder him, especially since the Jordanian legislator only allows the appointment of one insolvency agent to manage the estate and insolvency procedures and is subject to the supervision and control of more than one regulatory body. One of the most prominent results we have reached is that the Jordanian legislator has exaggerated the role of the insolvency agent and assigned him many tasks and responsibilities that are not commensurate with his legal position or professional qualifications and treated him as if he were a magic wand to solve and confront the challenges facing the troubled economic activity.
